Do expunged records show up on background checks? Usually they should not on a standard private employer check, because an expungement or sealing order removes the case from public court files, and in many states you may then answer "no" when asked about it. Two exceptions catch people out: private databases that copied the record before the order, and fingerprint checks for jobs such as police, schools and finance, which in some states can still see sealed records.
The details depend on your state, the offense and the exact words in your order. This page explains what the order usually does, where leftover records come from and how to clean them up.

Expunged vs sealed: what each order does
| Term | What it usually means | Who may still see it |
|---|---|---|
| Expunged | The record is erased or treated as if it never happened, depending on the state | Sometimes courts, police and certain licensing agencies |
| Sealed | The file still exists but is hidden from the public | Courts, police, and employers a law allows, often through fingerprints |
| Set aside or vacated | The conviction is cancelled, but the file may stay public with a note | Often anyone who searches the court index |
| Pardon | Forgiveness from the governor or president; the record usually remains | Anyone, though it shows the pardon |
States use these words differently. Some say expunge when they mean seal. Read your order, or ask the clerk what it does in your state.
Do expunged records show up on background checks? Where leftovers come from
- Old database copies: some screening companies buy bulk court data. If they copied your case before the order, their copy can outlive the court file.
- The order was not sent on: the court may not have told the state repository, or the state may not have updated the FBI record.
- Wrong type of relief: a set aside or a dismissal after probation can leave the case visible in the public index.
- Fingerprint checks: jobs covered by laws for schools, care work, banking or law enforcement may be allowed to see sealed files.
Federal law requires a screening company that reports public records for a job to report them as complete and up to date. An expunged case listed as an active conviction is not up to date, and you can challenge it.
How to clean up your background check after expungement
Follow the steps in order. Most cleanup is paperwork and patience.
- Get several certified copies of the order from the court clerk.
- Request your own state criminal history record to see whether the state updated it.
- If a fingerprint record is involved, ask the state repository how to update the FBI record too.
- Get a copy of your file from each screening company that has reported on you, then dispute the old case in writing.
- If an employer saw the old record, request that the updated report be passed to that employer.
It owes you a free reinvestigation, normally finished inside a month. For a fuller letter, see how to dispute errors.

Re: Record that was expunged, case [number], [County] court
The report you prepared for [employer] on [date] includes the case above. That case was expunged by court order on [date]. A copy of the order is enclosed. Please remove it from my file, confirm the removal in writing, and send [employer] an updated copy.

Will expunged records show up on an FBI background check?
They can. The FBI's file is built from fingerprints and outcomes that state and local agencies send in. If your state did not report the expungement, the FBI record may still list the arrest. Fingerprint checks are used for many licensed and regulated jobs, so it is worth checking. The FBI background check page covers how to request your own record, and the fingerprint check guide lists jobs that use it.
Background check removal services and free help
No company can make a court record disappear without a court order. Services that promise to remove your record usually just file the same petition you can file yourself, or only opt you out of people search sites, which employers do not use for FCRA checks.
Be careful with anyone who promises a clean background check for a fee. Courts, legal aid offices and many state bar programs help with expungement petitions at little or no cost.
To learn your rights as a consumer, read the FTC page on employer background checks. You can also complain to the CFPB through its complaint page if a company will not fix a cleared record after you dispute it.
Answering application questions after expungement
Many states let you treat an expunged or sealed case as if it did not happen when a private employer asks. Others make exceptions for government jobs, licenses or jobs with children. Read the question on the form and your state's rule before you answer. Your state's page and common application questions can help.
Laws on what you may say after a record is cleared are very state specific. Treat this page as an overview and confirm the details with a local attorney or legal aid clinic.
Questions people ask
Will a sealed record appear on a background check?
On most private checks it should not. Courts, police and some employers covered by special laws can still see it, often through fingerprint checks.
After expungement, how long until my background check is clear?
Court and state updates can take weeks or months. A screening company dispute usually takes up to 30 days after it receives your letter.
Can an expunged record be found in a background check?
Yes, if a database kept an old copy or the state did not update its files. Send the order to the screening company and ask it to delete the case.
Does an expunged felony show on a background check?
Not on a standard private check, as a rule. Jobs that use fingerprint checks under special laws may still see it in some states.
Is there free background check removal?
The court process itself is the real removal, and legal aid offices often help for free. Paid removal services cannot erase a court record.
Do I have to disclose an expunged record?
Many states say you do not for most private jobs. Government, licensing and law enforcement applications may still ask. Check your state's rule.
