Step 4Background checks

Background check consent form: what it says and what you are agreeing to

Short answerA separate disclosure plus your signed permission, required before a job check

  • Form fields
  • US federal law
  • Your rights
  • Checked 6 Nov 2026

A background check consent form is the paperwork an employer must give you, and you must sign, before it can order a background report about you from a screening company for a job. Federal credit reporting law says the disclosure has to be in a document that consists only of that disclosure, not buried in the job application, and your written authorization may sit on the same page.

You will see it called a disclosure and authorization form, a background check release form or simply background check paperwork. It usually arrives after a conditional offer, by email or through the employer's applicant portal. Here is what is on it and what each part means for you.

Quick answers

  • Required by

The federal Fair Credit Reporting Act, for reports bought from a screening company.
  • Format

A standalone disclosure. Your signed authorization can be on the same page.
  • Can you refuse?

Yes, but the employer may then not consider you for the job.
  • Typical fields

Full name, other names, date of birth, address history, SSN, driver's license, signature.
  • Extra notices

Some states add their own page; interviews about character need a separate notice.
  • Keep a copy

Save or print it before you sign.

Fields on a background check authorization form

Forms vary, but these fields appear on most of them:

  • Full legal name and Other names used, including maiden names and spellings
  • Date of birth, used to match court records to you, not to judge your age
  • Social Security number, for the identity and address trace
  • Current and previous addresses, often for the past 7 years
  • Driver's license number and state, only when a driving record is checked
  • Signature and date, sometimes typed as an electronic signature

Give your Social Security number only on a real employer's consent form, usually after an interview or offer. A request for it in the first message from a stranger is a warning sign of a job scam.

Is the I 9 form a background check?

No. Form I 9 confirms your identity and that you are allowed to work in the United States. Every new hire fills it out, usually in the first days of work. It is not a criminal check and does not need a separate consent. Some employers also use a federal online system to confirm I 9 details, which is still about work eligibility, not your record.

Healthcare, school and fingerprint forms

Jobs in healthcare, child care and schools often use state forms for fingerprinting instead of, or in addition to, the screening company form. These are processed by a state agency, often the state police, and then the FBI. They have their own consent wording set by state law. See healthcare background checks and fingerprint checks, or look up your state on background checks by state.

For employers: templates and PDFs

If you are an employer looking for a free background check authorization form template or a printable PDF, be careful. Many free templates mix the disclosure with waivers, state notices for other states, or job application questions, which can break the standalone rule. Have an employment lawyer review your form, and keep the disclosure short and clear.

Use a single page that says a report may be obtained for employment purposes, with a signature line.

Add a release of liability or bury the disclosure inside the application.

Questions people ask

Can an employer do a background check without my consent?

Not through a screening company for a job; the FCRA requires you to sign first. Looking at public records itself is a different matter for an employer, subject to state law.

What is a background check disclosure and authorization form?

The standalone notice telling you a background report could be used in hiring decisions, together with your signed permission. Federal law lets both appear on the same document.

What happens if I refuse to sign?

The employer is allowed to stop considering you. If you are worried about a specific item, ask what will be checked before deciding.

Does signing let them check my credit?

Only if the form and the package include a credit check. Look for words like consumer credit or financial history, and ask HR if it is unclear.

Can I get a copy of the background check consent form?

Yes, ask for one, or download or print it before signing. It names the screening company, which you will need to request or dispute your report.

Is a background check form the same as a job application?

No. The disclosure must be a separate document from the application. You may get both at once, but they should not be combined.
